The final judgment on the trade secret leak lawsuit between LG Chem and SK Innovation has been pushed backed again by the US International Trade Commission (ITC).
The ITC has said the final judgment will come on December 10. It is the second postponement by the agency.
It didn’t say why it was delaying the final judgment.
LG Chem has formed a joint venture with General Motors in the US __ they are planning to invest 2.7 trillion won together. Prior to that, it already had a factory in Michigan.
SK Innovation is building a battery factory at Georgia. It plans to invest 3 trillion won there __ this will increase to over 5 trillion won in the future, the battery maker has said.
LG Chem supplies its batteries to General Motors while SK Innovation is a supplier to Ford.
An ITC judgment against SK Innovation will hurt the ability of Ford to procure batteries.
Whatever the ITC final judgment turns out to be, the US President can reject the decision.
This happened only once prior when former US President Barrack Obama rejected the judgment of the commission in the case between Samsung Electronics and Apple.
LG Chem and SK Innovation have three lawsuits at the ITC. ITC took the side of LG Chem in one of those cases in an early judgment.
