US President Joe Biden must reject a ruling made by the International Trade Commission (ITC) against SK Innovation in its lawsuit with LG Energy Solution, former US Attorney General Sally Yates said.
The ruling threatens the creation of jobs in Georgia, where SK Innovation is building a battery plant, and hamper the ability of the US to combat climate change through wider use of electric vehicles, said Yates, who was hired by SK Innovation for advice on public policy aspects over its dispute with LG Energy Solution. Yates served as an acting attorney general in 2017. She is now works for law firm King & Spalding.
Enforcing the ruling will also put US behind China in electric vehicles which threatens US’s national security interests, Yates claimed. It will also restrict Ford and Volkswagen to meet the terms of the free trade agreement between the US, Mexico and Canada, the lawyer said.
LG, in turn, said discarding the ITC ruling will set a dangerous precedent.
In February, the ITC ruled that SK has stole trade secrets from LG. It ordered a 10-year import ban against SK. President Biden has the right to veto the ruling within 60 days of the ruling.
